Standards of Care a.k.a. Property Owners Liability Exposure
The HO policy’s liability coverage responds to claims based on the elements of negligence. However, the party making the claim and their reason for being on the property are factors to consider. Three groups traditionally have been recognized when applying the “standard of care” concept to an HO liability loss exposure: invitees, licensees, and trespassers. With respect to trespassers, the doctrine of attractive nuisance also factors in. Additionally, jurisdictions have abolished or modified these three common law classifications. So, “…if someone fell on my property and there is possibility of lawsuit… am I covered?” We’ll discuss possible answers to this very question!
